1. Acceptance of Terms
By downloading, installing, or using the Sportifyr iOS application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Sportifyr is a youth sports schedule management app that helps parents and guardians organize, sync, and track sports events and activities for their household. Features include schedule management, household coordination, third-party calendar and league platform sync, and subscription-based premium features.
3. Eligibility
You must be at least 18 years old to create a Sportifyr account. By creating an account, you represent that you are 18 or older and have the legal authority to agree to these Terms on behalf of your household.
4. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity that occurs under your account
- Notify us immediately at support@jingleinteractive.com if you suspect unauthorized account access
- We reserve the right to terminate accounts that violate these Terms
5. Subscriptions and Payments
5.1 Free and Premium Tiers
Sportifyr offers a free tier with limited features and a premium subscription with full access. Premium features are described within the App.
5.2 Subscription Terms
- Subscriptions are billed through your Apple ID via Apple's in-app purchase system
- Subscription periods are monthly or annual, as selected at purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Prices are displayed in the App and may vary by region
5.3 Cancellation and Refunds
- Cancel your subscription anytime through your Apple ID account settings (Settings → [Your Name] → Subscriptions)
- Upon cancellation, you retain access to premium features until the end of the current billing period
- Refunds are handled by Apple in accordance with their refund policy
- We do not issue refunds directly
5.4 Price Changes
We may change subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Upload or transmit any malicious code, viruses, or harmful content
- Impersonate any person or entity
- Use the App to collect or harvest data about other users without consent
- Attempt to reverse engineer, decompile, or disassemble any part of the App
- Use the App in any way that could damage, disable, or impair its operation
7. User Content
7.1 Your Content
You retain ownership of content you create in Sportifyr (athlete profiles, schedule entries, household data). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service.
7.2 Content Standards
You are solely responsible for the accuracy of the content you enter. We do not verify schedule data, athlete information, or any other content you provide.
8. Household Features
When using household features:
- You are responsible for managing who has access to your household
- All household members share access to schedule and athlete data within the household
- You represent that you have the appropriate authority to add other individuals to your household account
- We are not responsible for disputes between household members
9. Third-Party Integrations
9.1 SportsEngine
If you connect a SportsEngine account, your use of that integration is also governed by SportsEngine's terms of service. We are not responsible for the accuracy or availability of data provided by SportsEngine.
9.2 Apple Services
In-app purchases and certain authentication features are provided by Apple and governed by Apple's terms of service.
9.3 Google Sign-In
If you use Google Sign-In, your authentication is governed by Google's terms of service.
10. Intellectual Property
The Sportifyr app, including its design, code, trademarks, and content (excluding your user content), is owned by Jingle Interactive and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted, error-free, or secure
- Schedule data synced from third parties will be accurate or complete
- The App will meet your specific requirements
YOUR USE OF THE APP IS AT YOUR SOLE RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JINGLE INTERACTIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, MISSED EVENTS, OR SCHEDULING ERRORS, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless Jingle Interactive, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
14. Termination
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time through Settings → Account → Delete Account. Upon termination, your right to use the App ceases immediately.
15. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Cook County, Illinois.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and, where appropriate, via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
